§ 86-2. Residential collection service.

  • (a)

    Garbage cans required. The owner or occupant of each housing unit in the city shall provide a garbage can or cans as defined in this chapter of sufficient capacity to hold accumulated garbage, and such cans shall be kept in a place accessible to the employees of the city, but never upon any street, sidewalk or public place.

    (b)

    Collection location. Collections of residential garbage and rubbish shall be at curbside or other such locations as will provide ready accessibility to collection crews and vehicles. Where a resident of a dwelling unit is handicapped due to age or infirmity, an alternative location may be arranged with the city upon satisfactory proof of infirmity or disability.

    (c)

    Backdoor collection service. Residents who are not otherwise disabled or infirm may request backdoor collection services for an additional fee.

    (d)

    Waste to be placed in garbage can or plastic bag. All garbage, ashes and rubbish shall be placed in a garbage can or in a plastic disposal bag.

    (e)

    Collection and disposal fees. The owner or occupant of each housing unit in the city shall pay a fee for solid waste collection and disposal and yard trash collection. Such fee shall be set by contract between the city and such contractors as the city may grant franchises to for the collection and disposal of solid waste and yard trash.

    (f)

    Granting of relief from fees. Any owner or occupant of a housing unit otherwise required to pay a fee for solid waste collection and disposal and yard trash collection may seek indigent relief or extraordinary relief from such fees by making application and presenting sufficient evidence of indigency, undue hardship, or fundamental unfairness to the city commission. Upon receipt of any such application, duly appointed staff shall investigate the information set forth in the application and, within 30 days, shall make a recommendation to the city commission. Indigent relief and/or extraordinary relief from the fee may then be granted by a majority vote of the city commission.

    (g)

    Reduced service for persons granted relief from fees. If the city commission grants any owner or occupant indigent relief and/or extraordinary relief from the collection and disposal fee, the commission may also reduce, modify or otherwise restrict the level of collection services provided such owner or occupant.
