§ 78-120. Deferred pension for members leaving employ of city.

  • Should any member who has ten or more years of credited service leave the employ of the city as a police officer before he has satisfied the age and service requirements for retirement provided in section 78-117, for any reason except his disability retirement or death, he shall be retired 30 days from and after the date he files his application for retirement with the board on or after his attainment of age 60 years. Upon his retirement he shall receive a pension computed according to section 78-119 under the calculation that was in effect at the time he left city employment. If he withdraws his accumulated contributions he shall thereupon forfeit his right to a deferred pension provided in this section and shall lose all rights as a member. During the period of his absence from city employment and until his pension begins, his balance shall be accumulated at regular interest.
