§ 22-281. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Active certificate means a certificate of competency issued by the City of Starke Building Department that qualifies the holder thereof to practice his trade in the City of Starke.

    BTU means British thermal unit.

    Building official means that individual appointed by the city commission as the head of the building department, regardless of the job title of the individual.

    Certificate means a certificate of competency issued by the Building Department as provided in this article.

    Contractor means a person who engages in business, under express or implied contract, in the performance of those construction trades specifically included in this ordinance or who undertakes or offers to undertake or purports to have the capacity to undertake, or submits a bid to, or does himself, or by or through others, engaged in the business for doing such a construction trade:

    (1)

    Building, general, and residential;

    (2)

    Electrical;

    (3)

    Mechanical;

    (4)

    Pool;

    (5)

    Plumbing; or

    (6)

    Roofing.

    Specialty examination means a procedure or exercise, written, oral, practical, or any combination thereof, deemed appropriate by the Building Department, and which requires the payment of a fixed, non-refundable fee.

    Fee of competency means a fixed nonrefundable charge paid by all licensed contractors to register their license with the City of Starke. Such fee shall be established by the city commission to cover the cost incurred in the administration of this article.

    General contractor means a person engaged in the construction business who is unlimited in heights, area or complexity of construction. Generally, he subcontracts specialty work such as electrical, plumbing, heating, ventilation, air conditioning, refrigeration, or any other area of construction to subcontractors. However, he may elect to perform any or all specialty work for trades in which he is duly certified.

    HARV means heating, air conditioning, refrigeration and ventilation.

    Homeowner means a bona fide owner of a home or residential property which he occupies as his permanent residence and upon which he intends to work.

    Qualifying agent means a person who possesses the requisite skill, knowledge and experience, and has the responsibility to supervise, direct, manage and control the contracting activities of the business entity with which he is connected; who has the responsibility to supervise, direct manage and control construction activities on a job for which he has obtained the building permit; and whose technical and personal qualifications have been determined by investigation and examination as provided in this article, as attested by the building official or his duly appointed representative.

    Reciprocity means recognition by one governmental body of the validity of licenses or privileges granted by another governmental body.

    Renewal means the act of renewing a certificate of competency.

    Specialty contractor means a business or person who is primarily engaged in a single trade.

    Subcontractor means a person or business who contracts to perform work of a specific trade.

    Trade means occupations in the construction field which require skill, knowledge, manual ability and experience to perform, and include only those specific occupations provided.
